Whilst I don't agree with sueing the field, I think it's a bit rich to call this guy an idiot.

its a war game you play to win the war but i didnt sign up for this, well im sorry but if you play what is escentially a aggressive sport then you will eventually have someone take it too far, ive had it happen at fields, i know several fields that has similar episodes, and if you want to start calling people names on the field, and he's bigger then you, you better be prepared for what may or maynot be coming your way, its that simple, dont start what you cant or arnt prepared to finish.

but the fact remains the guy turned around and tried to sue a business for something that wasn't there fault!why didn't he sue the attacker? probly for the sole reason he thought he would get more money out of the paintball field and wouldn't get much out of the attacker! I mean come on that same thing could happen in a coffy shop or walking along a footpath and he is acting like the sole reason was he was at a paintball place

He didn't attempt to sue because it happened, rather because they didn't intervene whilst he was getting his head bashed in.

There is no waiver in the world that relieves a field of it's duty of care.

In the end, thankfully the field was found to have not breached its duty of care towards the player.

no offence to anyone else here this is only my opinion:

If a fight started in any group I was reffing; no offence but there is not much you can do about it. Pretty much all that can be done is try and keep the rest of your group controlled and safely out of the way then call in for the field supervisors or managers for back up when they give up trying to hurt each other.

A lot of the time confrontation can be talked down by the ref anyway, you can see when two players are getting a bit aggro at each other and most of the time one if not both players will approach the refferee to dob on each other for whatever it is they are upset about. Few words to the group about the spirit of good sport and butterflies in the wind before the next game / break and its all set to rock and roll again for a good, fun and SAFE day of paintball for everyone.

At the end of the day, it sounds like the guy he called 'big guy' was pretty upset before the name was called, hence hey he exploded so quickly..... im guessing there is alot more that was said / done than came out in the article too.

I feel for the guy. getting beat up isnt fun and getting brain damage as a result is worse and i hope the other guy ended up in prison.

but what i don't understand is why its news worthy. its a bullshit story. if they covered every fight that caused injury and went to court we would have 100 page newspapers.
